C로 만든 GPLv2를 사용한 어떤 라이브러리를 다른 언어로 porting하면 반드시 GPLv2를 사용해야 하나요?

C로 만들어진 어떤 라이브러리가 있습니다. 이 라이브러리는 GPLv2를 사용하고 있습니다.
이 라이브러리의 소스 코드를 보고 직접 다른 언어로 porting한다고 하면 - 즉 C로 만들어진 라이브러리를 링크하지 않고, 완전히 다른 언어로 새로 구현하면 - 포팅한 라이브러리는 반드시 GPLv2를 사용해야 하나요? 아니면 나름대로의 다른 라이센스를 사용해도 되나요?

소설과 소프트웨어는 둘 다 저작권(copyright)으로 보호되는데, 소프트웨어의 사례는 모르겠지만 예컨대 영어로 된 소설을 한국어로 번역한다고 하면 원작 소설의 저작권을 존중해야 하는 것이 당연한 관례입니다.

그냥 단순히 아이디어를 얻는게 아니라 알고리즘도 그대로 따라하고 소스도 직접 참고해서 봤다면 당연히 원 저작권을 그대로 달고 다녀야겠지요.

그렇지 않고 API 수준만 참고로 하고 소스를 *전혀* 안보고 완전히 새로운 구현을 했다고 한다면 그건 저자 맘대로

이런 문제때문에 자유 소프트웨어 헤커들은 다른 배타적 저작물 소스를 전혀 안본다고 하는군요...

다른 언어로의 번역도 "파생물"로 본다네요. 상식적으로 그게 정당하기도 하네요. 번역이라는 나름의 기여가 있었다 해도, 원 창작물에 기반해서 나온 건 분명하니까요.

따라서 번역한 결과물에도 GPLv2가 그대로 적용될 듯.
